Jody Sarak v. Michael/Michelle D. Chervy In this case, the Plaintiff alleges the Defendant contributed to the infringement of copyrighted material by a third person. A college student in the Professor's music appreciation class makes a musician's work widely available via the Internet. Was the student encouraged to infringe the copyright of the musician or was the student the lone infringer? Is the Professor liable for contributory infringement or was it a fair use of the musician's work in a scholastic setting?
2005 National Ranking --18th-- Pioneer Valley Performing Arts High School Gary Huggett Robert Shute United States vs. Cameron/Carmela Berncoat This year’s case involves a trial before a judge (commonly referred to as a “bench trial”) in Federal Court on a criminal matter. The charges, which the Prosecution seeks to prove beyond a reasonable doubt, are conspiracy, malicious destruction of property by arson causing death and malicious mischief. A researcher at a federally funded laboratory agreed to permit some members of an Animal Rights Organization to come inside the facility on July 4, 2004. During the course of the incident, several animals are released, a fire starts and a fellow employee dies in the fire. Did the Defendant agree to release the animals and damage the facility or did s/he merely agree to allow the individuals in the facility to take pictures and learn the lay out so they could free animals from a different facility at a later date. In addition, the Defendant raises as a Defense that s/he withdrew from the conspiracy in a timely manner.

Dannie Boyd vs. Findlay Auto Devices, Inc. This year’s case involves a trial before a judge (commonly referred to as a “bench trial”) in Superior Court on a civil matter involving product liability issues. The complaint, which the Plaintiff seeks to prove by a preponderance of the evidence, alleges that the Defendant negligently designed its product, breached express and implied warranties and that the negligence was the proximate cause of the Plaintiff’s accident. An owner of a portable Global Positioning System (GPS) is taking their spouse to the hospital in Boston. The driver looks down at the GPS screen and apparently misses a no right turn sign that was posted as a result of an easterly one way street having been reversed to a westerly direction. The driver turns right, proceeding east, and slams into a truck as it crosses the next intersection, leaving the Plaintiff driver’s spouse in a coma. The Plaintiff alleges that the accident would not have occurred had the GPS unit been properly designed. Is the design negligent? Was the product properly used by Plaintiff and/or was the accident foreseeable? Did the accident occur because of negligent design of the product or as a result of the Plaintiff’s negligent driving?
