Junk Fax Prevention Act
On June 28, the U.S. House of Representatives approved the Junk Fax Prevention Act of 2005. The bill prohibits unsolicited fax advertisements unless: (1) the sender has an established business relationship with the person; and (2) the advertisement contains a conspicuous notice on its first page that the recipient may request not to be sent any further unsolicited advertisements.
The bill does authorize the FCC to allow professional tax-exempt trade associations to send unsolicited advertisements to their members in furtherance of association purposes.
The bill now moves to the White House for final disposition.
Congratulations to our good friends at the American Society of Association Executives for their leadership in moving the bill out of the Senate and onto the House floor.
